Oh, you're here. Melissa, are you okay up there? Okay, good. Let's call the Board of Directors meeting open session October 13th, 6 p.m., Water Tower. Sorry, we're running just a slight behind here. [0:01:05] Okay. As we get a little dinner here. President, actually this is property owner comments. [0:01:13] Property owner comments. Okay. So we have three, that's it? And I have one online comment. [0:01:20] Okay, so four people. Okay, property owners, Chris Gott, Eagle Mountain, 039, do you want to step forward? [0:01:37] And you're, you wrote here multi-use room. [0:01:40] Yes. Multi-use room at Riverside Park that was supposed to be, that was squashed without discussion. It was called an adult. [0:01:58] We just changed the name and carried it forward instead of squashing an amenity that money's already been paid to buy some of the product. [0:02:11] On the Riverside. [0:02:15] Are you looking for us to answer your question? [0:02:27] After the meeting? Okay. If you don't mind. I got to keep going. Could you please continue? No, that's fine. Okay. I'm trying not to interrupt. Okay I'm trying to put it out there for the time being. [0:02:27] We will [0:02:32] write a formal notice to the community. [0:02:37] But a formal notice or a discussion or anything was not [0:02:41] had. It went to legal counsel for review. [0:02:52] Really? We don't have any answers. We have a lot of [0:03:17] answers. I can tell you that, number one, the expense [0:03:21] to put that facility into play. [0:03:26] We have a lot bigger issues right at the point [0:03:29] that have to be addressed. I mean, significant issues [0:03:33] on our plate as a board to make decisions on. [0:03:40] So we will [0:03:41] formulate something and get it out to you all [0:03:48] with that. I mean, your point's correct. [0:03:52] Adult room, whatever you wanted to call it. We'll take [0:03:56] that into consideration as well. [0:03:58] Financially, we cannot afford [0:04:02] as an association to go any further on that at this [0:04:06] point. But we've already purchased 90% of everything [0:04:10] for it. The expense is there. It's done. [0:04:17] But there are additional expenses that come [0:04:20] into play. And at this point in time, it's not [0:04:29] feasible. Liz Ford, EMC 354. [0:04:46] Hello. [0:04:53] I'm just going to read something so that I can get [0:04:55] all my points in, especially with the time in the room. [0:05:01] It was a gathering place for adults from both the campgrounds [0:05:24] and house subdivisions to hang out and watch a football [0:05:27] game, a movie, play a board game, checkers, crafts, [0:05:30] do some great from home, things like that. [0:05:33] Just chat. [0:05:38] Again, it was approved. [0:05:46] I had intended for the community room to be open [0:05:48] around the time that we could go open and continue. [0:05:51] After we get together two, maybe three times a week [0:06:07] based on people's interests, like how we were told that we [0:06:15] would not have any staff. [0:06:16] What we paid for would be strictly a volunteer thing. [0:06:31] And we've already got chairs and a cabinet [0:06:34] have all been purchased to be when the money got [0:06:40] stopped because we had it all ready to go. [0:06:50] Full-time residents. [0:06:54] And I have, I think people thought [0:06:57] it was for the campground. [0:06:58] There are houses that are already there, too. [0:07:00] They have to drive just as far as the rest of us, [0:07:02] 30 minutes over the year, to use any of the other amenities [0:07:05] we all pay for. [0:07:07] So I have three people's names who've already [0:07:10] said they were interested. [0:07:11] I don't know if it's a great company. [0:07:12] I know one's in Florida. [0:07:14] But my issue is that for the initial purchase of the tables, [0:07:18] chairs, the TV, and the cabinet, we would not [0:07:19] be asking for any more money. [0:07:22] We wouldn't use the cleaning staff. [0:07:23] We could take care of ourselves. [0:07:25] And I also want to make it totally clear [0:07:27] that the space was always intended [0:07:28] to be used for any and every owner who wanted to come. [0:07:31] So the naming of the room as an adult room [0:07:39] wasn't to exclude anyone, per se. [0:07:41] However, from time to time, the adults [0:07:43] liked wanting to watch more than we could for the event. [0:07:52] They could have their own thing if they were going [0:08:04] to be responsible for the room until about 24 hours [0:08:14] before the information. [0:08:18] Anybody who's interested, if you want to do this, that, [0:08:22] and the other, you know, [0:08:59] out of place, in terms of married or single older people, [0:09:09] because especially single people, if they've been widowed [0:09:12] or widowed over the years, depression, studies have shown [0:09:18] that people can't get around to the side of the river. [0:09:27] So I was just looking for things that they're friends. [0:09:31] So you know, that was my point clearly, [0:09:44] why they just cut us off with that thing. [0:09:46] Let's have an informational meeting. [0:09:48] We just made a decision without even asking. [0:09:52] And that's what I wanted to know, I wanted to say. [0:09:54] Thank you, Liz. [0:10:07] Tom Kenny, EMC 434, agenda number nine, STR. [0:10:16] Yeah, this is in regard to number nine on the agenda, [0:10:20] Ross, which is the short-term rentals discussion. [0:10:26] First of all, I'd like to introduce myself. [0:10:28] If you don't know me, I'm Tom Kenny. [0:10:29] I was a former board president. [0:10:32] Before any vote gets taken on agenda nine, [0:10:35] I believe the homeowners deserve to understand [0:10:37] how this issue was first presented to me [0:10:40] and what occurred on May 4th of 2026, [0:10:44] while I was serving as board president. [0:10:47] On May 4th, Director Nick Jackson contacted me [0:10:51] unsolicited via text message regarding the removal [0:10:56] of the short-term rental fee. [0:10:58] His opening message stated, Ross said you'd be on board [0:11:02] with voting to remove the short-term rental fee [0:11:05] and make it so they have to be added to covenants [0:11:08] to treat a subgroup of owners different than others [0:11:11] as it should be. [0:11:12] If that's accurate, I'll get an email sent over [0:11:15] to add it to your agenda for next board meeting. [0:11:18] The message also added, we'd be happy to help [0:11:21] with any votes you need in the future. [0:11:24] I responded that I supported legal principles [0:11:28] that the board should not create fees or obligations, [0:11:32] that are not authorized by the governing documents, [0:11:35] and that the principle applied to short-term rental fees [0:11:38] that should apply consistently for all fees [0:11:42] throughout the membership. [0:11:45] As the discussion continued, the focus shifted [0:11:48] from legal principles to voting positions. [0:11:51] I was informed that they, as Nick has stated, [0:11:56] two directors, Kurt DeVries and Graham Anthony said [0:12:02] will only vote for a short-term rental removal, plain language. [0:12:06] They don't want to get involved with any board's resolutions on septic, [0:12:10] and they will vote for campgrounds to pay their own septic [0:12:13] and move forward with that if we cannot get the short-term [0:12:17] resolution through. We can all make a determination [0:12:22] on what that says. I believe homeowners [0:12:26] should understand that the significance of these statements before any public meeting [0:12:30] or before any discussion with the membership and before any vote on the [0:12:34] board, I was being advised how certain directors intended to vote on short-term [0:12:38] rental fees, how they intended to vote on septic-related matters [0:12:42] and what would occur if the short-term rental proposal failed. [0:12:46] The discussion repeatedly focused on vote counts, voting commitments [0:12:50] and how proposals should be structured and [0:12:54] obtain support. Homeowners should also recognize that [0:12:57] the directors discussed here [0:13:00] are all short-term rental owners and financially [0:13:04] would benefit from a removal of these fees. [0:13:08] I declined to participate in the process. As the board president, [0:13:13] I believe that matters affecting the membership should be discussed [0:13:16] openly, debated openly, and decided openly. I was not [0:13:20] willing to participate in private discussions regarding board votes or [0:13:24] proposals before they were publicly presented. When those [0:13:28] discussions did not result in sufficient support, [0:13:32] leadership later shifted in pursuing an administrative [0:13:35] usage study under Article 2, Section 8 of the Bylaws. [0:13:41] Homeowners should also consider that [0:13:44] again, Nick was placed in charge of this, I believe, Ross. [0:13:49] Okay, so you have a conflicting or [0:13:52] potentially conflicting director put in charge of overlooking [0:13:56] a study that, [0:13:58] financially, benefits that director. [0:14:01] At the June 9th meeting, again, I just said that to you, Ross, [0:14:05] you appointed Nick in order to get these numbers together and [0:14:10] so forth for today's meeting. Am I correct with that? [0:14:13] That's correct. [0:14:14] Okay, correct. That raises legitimate concerns regarding [0:14:19] independent subjectivity and reliability of any study. [0:14:23] Furthermore, on June 9th, the board enacted a moratorium, [0:14:28] on Section 8, again, Article 2, Section 8 fees, because of recognized legal [0:14:34] concerns regarding those fees. Yet, when that vote occurred, no sitting director [0:14:40] publicly disclosed on record that they owned, operated short-term rentals or stood [0:14:45] to benefit, financially, from the suspension of those fees. Gary, I will ask [0:14:53] you as a secretary, do you have any of those disclosures on record that have been given to you? [0:14:58] No. [0:14:59] Okay, thank you, sir. [0:15:00] Because these disclosures don't exist, homeowners should consider whether the same standards [0:15:05] being applied tonight were applied when fees benefiting short-term rental owners were suspended. [0:15:11] Proceeding with the agenda, number 9, without addressing those precedents, and without addressing [0:15:17] the disclosure issue, creates the appearance of inconsistent governance. Basically, that's it. [0:15:25] Thank you very much, gentlemen. And if you could tell me where I sign up for the door, please. [0:15:33] Great, thank you. [0:15:34] I have an online comment from Ron Roane, EMC 661. I am disappointed that the project was [0:15:46] cancelled, seeming, I'm sorry, it's Riverside Rec Room, seeming without seeking a solution to the adults only aspect of it. [0:15:53] Some discussion and seeking input from those who initially involved in the project should have happened, rather than the abrupt cancellation. [0:16:01] What is his address? [0:16:06] EMC 661. [0:16:08] I'm just going to, I'm just going to make my point. [0:16:21] Okay. [0:16:22] to make a comment on the rec room. [0:16:27] Ms. Ford, you were assigned this project [0:16:30] while you seated on the board, [0:16:32] along with actually, [0:16:37] you were given this project task about the rec room. [0:16:47] Ryan says so. [0:16:49] I'll give him a new one. [0:16:55] Ms. Ford, I just want to make sure [0:16:58] that I'm clear on this. [0:16:59] The rec room or adult room [0:17:02] or Riverside Pool Activity Center, [0:17:05] you were assigned this project as a board member? [0:17:09] I'm calling it up, and I present it. [0:17:13] Were you also assigned as the board member [0:17:17] to administer the camping, open camping? [0:17:26] Yes. [0:17:32] Was there also, during the development phases, [0:17:39] did you present anything [0:17:40] to the board what the plan was for the Riverside Pool area? [0:17:58] Chris was there. [0:18:00] Yeah. [0:18:05] Any other board members have any questions for me? [0:18:07] No. [0:18:11] Mike, anything? [0:18:14] I have this. [0:18:24] Ms. Ford, I've reviewed the minutes. [0:18:27] Can you speak up? [0:18:29] She says it's rejected. [0:18:30] It's really hard to hear you. [0:18:32] All right, can you hear me? [0:18:33] Yes. [0:18:35] I've reviewed the minutes from December 20, [0:18:38] 2005, when the issue came before the board. [0:18:43] Can you hear me? [0:18:44] Yeah, it went off. [0:18:46] Well, I'm not the one. [0:18:48] December of 25, I think it was December 9, [0:19:01] took up the issue, your request, [0:19:06] for the community room at Riverside. [0:19:11] At that meeting, the... [0:19:14] Mr. Stank, let's see if I can hear you. [0:19:18] Look, can you hear me? [0:19:20] Can you hear me now? [0:19:23] Anyway, at that meeting, the board suggested that the general manager [0:19:34] and I forgot, I could look it up, do some research on what it would take [0:19:41] to do to make your request happen. [0:19:46] That information was to have been returned to the board in February of 2026. [0:19:53] What is it? [0:19:55] Did you record and [0:20:06] were there [0:20:07] too many [0:20:18] minutes left? [0:20:19] Does that help? [0:20:20] That's great. [0:20:20] We're looking at a lot. [0:20:20] We can help. [0:20:21] don't forget. [0:20:21] Sure. [0:20:21] Go ahead. [0:20:22] That was effective. [0:20:22] There was no record in the minutes of the board meetings [0:20:23] board at the same time and you were assigned that project and you were to [0:20:30] deliver a basically a feasibility study and you also had the the direction to [0:20:41] also work on the campground the open camping [0:20:59] measure what was there I look to see what was working and not working my [0:21:06] point person or sending me more about it than that we even brought fung no leads [0:21:12] in agreement of sustainable access to model of direction and honestly I'm not [0:21:24] trying to get involved as the GM assistant GM if she thought I was [0:21:29] listening something else maybe she could told me they got misunderstood with [0:21:32] themselves said but I thought what some good money was approved it was approved [0:21:36] and I went through her to tell her what we wanted and she [0:21:40] you know what I'm talking about I'm talking about you know I'm talking about [0:21:40] if I remember right I'm asked Liz when this came before the board there was [0:22:02] discussion if I remember correctly that some kind of an organization was going [0:22:09] to have to be established similar to like the Good Neighbor Club to oversee [0:22:13] this process and the other other issue was [0:22:20] safe access to the to the building because of the pool and the you know the [0:22:27] danger of somebody falling into the pool I think those were two I have that exact [0:22:32] I have those exact notes so you're saying it's an adult only area you're [0:22:59] saying that it's an adult only area then at that point [0:23:04] so with the business that we have going and I was going to say this in my [0:23:23] general manager's report you know if we announced to the community that we we [0:23:27] canceled the idea of doing the community room on September 24 so what I was going [0:23:38] to say is that we announced the community that we [0:23:42] were not going to pursue the community room the 24th of September the board [0:23:48] decided not to move forward with the proposed adult community room at [0:23:51] Riverside pool and the plan to open house sessions were canceled the board [0:23:56] considered advice from our legal association legal counsel concerning [0:24:00] potential age discrimination concerns liability exposure and safety risks [0:24:05] related to an unsupervised space we appreciate the homeowners who expressed [0:24:10] interest in shared ideas for this proposal [0:24:12] But ultimately, the decision was made to protect the interest and safety of the association and its membership, and they did not want to pursue it. [0:24:20] So my question to you then is, why did you not come and ask me, and I would have gotten with Chris, the ones who started it all, and said what your concerns were about my wording? [0:24:29] You could have called it the Gathering Place. [0:24:32] No one had said there was an issue with what I called it, but yet you went to a lawyer first. [0:24:37] It's not just the adult thing. [0:24:41] We're not arguing that. [0:24:42] It's also the liability concerns of having that space open and who's going to take care of it. [0:24:49] I already said we had the volunteers set up. [0:24:51] Again, I had these conversations with Amy. [0:24:54] I have another homeowner that was there. [0:24:56] I don't know why we're discussing it. [0:24:59] And she wasn't supposed to be responsible for it, and she shouldn't have told us and ordered things. [0:25:04] She was implied to be a person in charge. [0:25:10] She wasn't. [0:25:11] She shouldn't have said so. [0:25:12] She's the assistant GM. [0:25:14] Okay. [0:25:14] I'm going to apologize for all of us. [0:25:16] We did not have all this information. [0:25:19] I can tell you that financially we are not moving forward. [0:25:23] We have legal guidance that says we're not moving forward. [0:25:27] So I'm sorry. [0:25:28] Are you going to return the tables and stuff? [0:25:31] They're already gone. [0:25:32] We can't. [0:25:33] We've had them. [0:25:34] We'll repurpose them. [0:25:35] They're going to be repurposed. [0:25:37] Hey, you know what? [0:25:41] You're disappointing other people. [0:25:43] You're more than me. [0:25:43] I don't go up here full time. [0:25:44] I was going to steer at it. [0:25:46] Try to get to know some of my neighbors. [0:25:47] We have really great house neighbors right around the corner. [0:25:50] They were interested. [0:25:51] I have e-mails from them. [0:25:52] I select e-mails. [0:25:55] So it's on you. [0:25:56] I mean, really, it's on you. [0:25:58] Okay. [0:25:59] That's it. [0:26:00] Anybody else? [0:26:07] Mr. Chatham, if you would welcome us in vocation, Pledge of Allegiance. [0:26:21] Dear Most Gracious Father and Heavenly Father, [0:26:24] Father, we come to this aisle in the name of the Lord. [0:26:26] We thank you for your praise to the Lord. [0:26:27] We thank you for all that you do in our life and in this community, God. [0:26:31] And, Father, I pray that through this night, Lord, and through the upcoming days, God, [0:26:36] how, Lord, you'll just work through us all, Lord, and be brave to be just a great community, Lord. [0:26:43] I pray, Father, that you'll bless the homeowners, the staff, Lord, the board members, God. [0:26:48] But most of all, God, that you'll bring us all together this morning. [0:26:51] That we might be a blessing to you. [0:26:53] Thank you for your salvation. [0:26:54] I love you with all my heart. [0:26:56] I pray in your name. [0:26:57] And we trust that you'll pray. [0:26:59] Amen. [0:27:01] I pledge allegiance to the United States, to the flag of the United States of America, [0:27:10] to the republic for which it stands, one nation, under God, indivisible, with liberty and justice. [0:27:25] That's Air Force 4. [0:27:29] Call the order and roll call, please. [0:27:31] We're calling this session to order at 630. [0:27:38] Roll call. [0:27:46] Nick Jackson. [0:27:48] Here. [0:27:49] Ross MacLaren. [0:27:52] Here. [0:27:53] Kurt DeVries is excused. [0:27:55] Richard Stonecipher. [0:27:57] Here. [0:28:00] Thomas Anthony. [0:28:02] Graham is excused. [0:28:05] Gary Brown present. [0:28:06] Mike Padgett. [0:28:07] Here. [0:28:08] Shirley Starling. [0:28:10] Leah Godfrey. [0:28:11] Here. [0:28:11] We have a quorum. [0:28:13] Hey, Gary. [0:28:14] This is Graham Anthony. [0:28:15] I'm here. [0:28:16] Oh, Graham, you're on. [0:28:17] Okay. [0:28:18] You made it out of the wilderness. [0:28:21] Out of the wilderness. [0:28:22] Kurt should be on in a minute. [0:28:24] Okay. [0:28:24] Good. [0:28:30] Approval September 8th, 2026 minutes. [0:28:38] I do have a question about the minutes. [0:28:40] This is Richard Stonecipher. [0:28:43] Leah and I were talking. [0:28:44] We met at the post office the other day, and she said, [0:28:49] Do you remember talking about, during the meeting, about ARC not doing every weekly inspection? [0:28:58] Because Sandy said that it wasn't necessary. [0:29:00] And I said, Well, yeah, I remember me and you talking about it, and I remember Ross, [0:29:05] but I looked in the minutes and the executive minutes, and I couldn't find nothing about [0:29:09] it. [0:29:10] So correct me if I'm wrong, but by doing it like that, did I oversee it, or did it just [0:29:19] not fit in there? [0:29:20] The minutes reflected. [0:29:21] Hold on. [0:29:22] Let me look at it. [0:29:23] Okay. [0:29:24] I'm sorry. [0:29:29] We had a discussion, but discussion, everything in a discussion doesn't get included in the [0:29:33] minutes. [0:29:34] Okay. [0:29:35] What gets included in the minutes is the motions that are made and the results of the [0:29:40] motions. [0:29:41] But yes, we did discuss the frequency of inspections and, you know, how that process works for [0:29:47] an extended period of time, but that's discussion. [0:29:50] Okay. [0:29:51] Thank you. [0:29:56] I approve minutes as read. [0:29:57] Without objection. [0:30:00] Next thing, adopt the agenda for today. [0:30:01] Any changes? [0:30:12] No. [0:30:13] Okay. [0:30:14] Any changes? [0:30:16] This is Stone Cipher. [0:30:17] I've got a couple of things I'd like to add for clarity. [0:30:21] I'd like to speak about budget process, financials, and collections, and I would like that to [0:30:29] be under 5 A, B, and C. [0:30:35] 5 A, B, and C? [0:30:41] Yes. [0:30:42] 5 A, B, and C. Budget that's related to committee appointments. [0:30:50] I don't know. [0:30:51] They ought to just be separate items. [0:30:53] Yeah. [0:30:54] Let's just do it separate items. [0:30:55] Separate items. [0:30:56] But can you say them again, please? [0:31:00] Budget process, financials, and collections. [0:31:08] Can that all be one item? [0:31:10] Yes. [0:31:11] I'm just going to go through it as I go. [0:31:14] Hey, guys. [0:31:15] Just want to jump in. [0:31:16] This is Kurt. [0:31:17] I'm online. [0:31:18] Hey, Kurt. [0:31:19] Thanks. [0:31:20] Hey, Kurt. [0:31:21] We got you. [0:31:22] All right. [0:31:23] Awesome. [0:31:24] Thank you. [0:31:25] Mr. President, maybe that should be, what number would you like to assign that? [0:31:38] Can we have that at line 10? [0:31:41] That'll be 10 and renumber everything after that? [0:31:47] Yes. [0:31:48] Let's do that just before the Treasurer's Report. [0:31:53] You're going to put it at 10? [0:31:55] We'll make it 10. [0:31:56] We'll make it 10 and then move everything else down. [0:31:58] Okay. [0:31:59] I'm good with that. [0:32:00] Okay. [0:32:01] Mr. President? [0:32:02] Mm-hmm. [0:32:03] At last meeting, we had an item tabled regarding property owner attendance at board meetings. [0:32:10] Would the board like to revisit that issue? [0:32:15] If we don't revisit this issue, then it's dead. [0:32:22] Or at this meeting, rather. [0:32:24] Then it would die. [0:32:25] Well, let's see. [0:32:34] How many people are online tonight? [0:32:36] 42. [0:32:37] We can. [0:32:38] We can add it. [0:32:48] Make that 11 and renumber everything? [0:32:49] Yeah, that's fine. [0:32:50] Make it 11. [0:32:51] What was the name of that, Gary? [0:32:52] It was your motion about creating some kind of incentive for property owners to attend [0:32:53] the meetings. [0:32:54] Just kill that motion. [0:32:55] Kill it. [0:32:56] Okay. [0:32:57] Kill that. [0:32:58] Also tabled at last meeting was the Eagle Mountain Campground water rating. [0:32:59] That's right. [0:33:14] So, the Eagle Mountain Campground Water Rate increase. [0:33:15] Would the board like to consider that on the agenda? [0:33:19] I can speak to that briefly in my treasurer's report. [0:33:23] We'll just keep it at treasurer's report. [0:33:27] Okay. [0:33:28] And then, Mr. President, do you want to add gear management and steps to the river issues? [0:33:35] Yes. [0:33:36] So, make that 11? [0:33:38] Yeah. [0:33:39] And 12? [0:33:40] Yeah. [0:33:41] I can't keep up with these straight up. [0:33:45] Okay. [0:33:46] later we're going to make the deer management 11 yeah and then the steps to the river will be 12 [0:33:57] 12 is steps also i think as secretary i need to report for the minutes that [0:34:06] during the past month under the authority of article 4 section 14 the board took action [0:34:12] without a meeting to terminate the riverside adult community center project that needs to [0:34:17] be entered in the minutes of this meeting i agree okay a lot of changes keep us on target okay [0:34:33] committee appointments this is graham uh just real quick question uh should should the minutes [0:34:40] also reflect that that board was um cancelled that uh upon advice of of council make sure the [0:34:49] board minutes reflect that also if you want to add that to the to the entry on advice of council [0:35:00] yeah i think that's prudent and proper [0:35:03] um in terms of um the reason why we did it it wasn't just done out of um [0:35:10] any whim it was done with with advice of council [0:35:21] amy do we have any committee appointments yeah they're on a separate sheet of paper [0:35:25] right here hold on mr president yeah because we need to adopt the agenda as amended [0:35:30] if there's no objection okay anybody want any discussion on these uh committees [0:36:22] go ahead um i'm chairman of the architectural review committee and uh the committee would like [0:36:29] mr coles to be appointed by the president and affirmed by the board [0:36:34] he's coming in on that well you okay the president appoints the board confirms [0:36:42] uh but the architectural review committee would like him to be appointed to the committee [0:36:47] and who is that andrew coles andrew coles i'll make a recommendation andrew coles is [0:37:00] uh put on the architectural committee terminal committee and nick's on board here or nick's [0:37:16] online rather the charter for this committee requires that the chairman be a short-term renter [0:37:26] however the membership is supposed to be evenly split and i think maybe we i think all these [0:37:36] people are all owners of short-term renters so the board has a choice we either change the charter [0:37:42] to allow all these people to be members or we ask the committee to revisit and try to find [0:37:50] members that are not short-term rental property yeah i think that's right um i would welcome any [0:37:59] non-torture rental owners to join we have not had any applicants as at this time but i'd be happy to [0:38:04] take i'd be happy to take them yeah that's the problem we had no no uh volunteers i know as of [0:38:13] right now we don't even have enough members to like hold an official meeting so you're right gary [0:38:18] we need to either adjust the charter or i don't i don't know how we try to recruit more members but [0:38:22] um this is also can serve as a public announcement to anyone uh willing to serve we would love to have [0:38:28] you when is the meeting when's the meeting meetings are usually every month yeah um it [0:38:39] tries to be like the 23rd of each month but it's flexible we only have a couple of members now [0:38:45] they're all via google meet so we try to we change it from week to week based on [0:38:50] availability but we usually aim for the 23rd [0:38:59] apply there's an application online at the website and then you can just email [0:39:07] your application to application at mycrra.com should we um [0:39:16] yes not amend the uh the committee [0:39:20] and do anything with the committee until the next meeting to see if we get some more applicants [0:39:25] and then we make a decision that's fine but i think we ought to hold off on these right now [0:39:31] because we can't overload the committee with yeah with sdr property numbers which they all are [0:39:39] that's fine and one thing there are flyers of every committee that we have over here on this [0:39:46] table if anybody is interested and wants to know more about what the committees do that information [0:39:51] is available for you on thank you sorry i think we need to call the question on [0:40:05] um um confirming andrew coles as a member of the eight architectural review committee you want to [0:40:13] do a vote on it or something maybe without objection unless somebody Andrew Coles to [0:40:18] the architectural committee any any discussion current nick bram no objection from nick [0:40:32] bram no objection from the floor no objection from kurt what do we have five a b and c did you [0:40:59] have something no now we're on uh that we scribbled that so hold on yeah the change [0:41:06] the changes come i got to make myself a note here before we run past it it's fine we can't hear you [0:41:11] all you just it changes the arc yes we made a uh andrew coles has been put on the arc committee he's [0:41:24] row here community survey yeah community survey um as you all well maybe you're not aware but we [0:41:43] ran a community survey for kusawati to get the input from the homeowners of what was important [0:41:50] it was pretty pretty long survey um but remarkably we had nearly um nearly 400 uh responses so it was [0:42:02] a great uh response and i thank everybody that did participate in that um we're combing through [0:42:09] all of the uh statistics on it um it was actually kind of impressive because a lot of [0:42:17] uh of the information we got back this organization's already working on on a majority of it [0:42:26] roads gates uh amenity uh there isn't yet i can [0:42:37] move [0:42:37] there will be it's still being formulated but it's excellent information and it was [0:42:43] it was very promising to see that the board actually was had the pulse of the community [0:42:52] uh as i can tell you when i read through it i was like we're actually working [0:42:56] on what the community um i didn't test because we're great me neither [0:43:07] um yeah it was or it was around may we sent it out via via if you're getting the weekly newsletter [0:43:17] that's how the link went out um and i don't remember the exact date but it was somewhere [0:43:27] it was around in may i knew it was oh i'm sorry i take that back it was july july i was wrong [0:43:33] pardon the newsletter no it went out as its own email [0:43:44] i can resend it i mean i have no problem with that i'll just reactivate it [0:43:57] let us do this let us do this i'm going to make the uh decision right now [0:44:06] let us compile what we have and send it out to you we'll have it in the newsletter of what was [0:44:13] there i mean nearly 400 responses um and then i would like to continue these surveys and uh let's [0:44:23] say uh every six months it doesn't hurt nothing it looks like it was sending out like uh july 9th [0:44:35] it went as a constant contact to everybody so went out july the 9th he said went out july 9th [0:44:44] um it was a constant contact to everyone and then we closed it july 23rd um and then we [0:44:51] eventually had announced the participant [0:44:55] for the winner of the swag bag shortly thereafter um in late july so at the end of the day it was [0:45:10] great and we're going to continue to do it because we want the feedback um so i'm sorry if you didn't [0:45:16] get it um there'll be more to come gate strikes as you are all aware the new gate systems are [0:45:28] being installed the previous gates will be are being replaced um the continuation of gate [0:45:35] strikes forced us to uh have signage put up that explained if you hit the gate touch the gate [0:45:44] that you were going to receive a 500 fine and a two uh fifteen hundred dollar uh repair cost [0:45:52] with the possibility of increase based on the parts that you damaged [0:45:56] uh i am uh very happy to uh um the roads and grounds for getting those signs prepared and put [0:46:05] up the signs worked we've had one gate strike it was recorded the responsible party has paid [0:46:15] uh so it it worked and that was a that was an advisement from the folks installing the gates [0:46:25] said you really need to have these signs so it's working i know they're ugly but at the end of the [0:46:32] day they've they've stopped the gate strikes and the responsible party has paid uh so it worked and [0:46:37] it will be restructured over and over uh just to uh you know also to dried many other [0:47:03] countries um this is to uh move the gate strikes schools along again uh but i suck i suck a sun [0:47:13] really soft uh targeting areas bless ви [0:47:13] should get rid ofnh [0:47:14] being built and we are chasing after them [0:47:14] local sheriff as it is notified immediately on the gate-strike and they send out an officer and he collects the insurance information and or has them come by the POA to pay ARC rule change yeah yes last month the board last month the board assigned the ARC committee to work on a private [0:47:15] to improve the building permit process the there was a workgroup convened of [0:47:27] some contractors and some key staff that looked at the whole process and rebuild [0:47:33] it from the ground up their goal was to simplify the process but incorporate [0:47:39] needed improvements the revision necessitates revisions of article 10 of [0:47:46] the rules as well because the new process the rules require all these [0:47:53] complications that are not in the new process the architectural review [0:47:57] committee is recommending increases in impact fees related to construction of [0:48:01] homes and similar structures requiring a foundation and the architectural review [0:48:07] committee is prepared to implement this [0:48:09] you [0:48:09] as soon as the board approves the required rule changes the new house [0:48:15] building permit application will be for any any construction of any new [0:48:20] additions to a replacements of homes as well as constructions of garages decks [0:48:24] because carport screen rooms and other accessory structures that require a [0:48:29] foundation the excuse me the application is entirely [0:48:38] one-line for property owners to access through the homeowner's [0:48:43] portal and the associations websites and I believe it's online right now the [0:48:48] online process will not allow the application to be submitted to the staff [0:48:53] unless it's complete and obviously confusions or misunderstandings related [0:48:58] the handwritten applications is eliminated and that's one of the big [0:49:02] problems we have the applications now include a requirement that all [0:49:06] outstanding assessments fees fines and other delinquent charges levied against [0:49:09] the lot must be paid for and to the community as a whole there is a need to [0:49:13] paid before the application is approved. Our attorney says that is [0:49:16] legal. It only applies to the lot in question [0:49:20] if somebody owns multiple lots. And they're delinquent on every one, but that [0:49:24] one, we've got to give them the building permit. The Architectural Review [0:49:29] Committee may require erosion control and site drainage [0:49:32] plans on a case-by-case basis. This is to prevent [0:49:36] stormwater runoff problems for adjoining property owners or on [0:49:40] the association's roads and stormwater drainage system. [0:49:44] The previous requirements for driveway permits and land disturbance [0:49:48] permits and impact fees has been eliminated. These are now included [0:49:52] in the single building permit process. [0:49:57] And the Architectural Review Committee intends to implement these [0:50:00] immediately once the rules get changed. Now, in the proposed [0:50:05] rule change, Article 10 of the rules related [0:50:09] to residential building requirements has been developed in a layering [0:50:13] process over the years that's created unnecessary and confusing [0:50:17] rules. The proposed rule change is a complete revision and is [0:50:21] required to adopt the streamlined building permit process. The [0:50:25] Architectural Review Committee requests this change be adopted under the emergency [0:50:28] provisions of Article 7, Section 1 of the rules [0:50:32] to allow the immediate implementation of the streamlined new house [0:50:36] building permit process. [0:50:39] Rather than go through the 60-day adoption process, we're asking it [0:50:43] to be approved today. The proposed rule retains essential policy [0:50:47] requirements requiring board approvals, but eliminates unnecessary details [0:50:51] or details better addressed in the architectural standards. [0:50:55] Section 1 of the proposed rules, new construction establishes [0:50:59] a policy framework to implement the streamlined [0:51:02] building application. Section 2, well, [0:51:09] the evening of the new house will require a building permit and a building permit allow. [0:51:11] Section 1 of the proposed rules requires that the building permit be [0:51:15] copied into an external building permit and a building permit be [0:51:17] replaced. If the building permits are changing, then the constructed [0:51:19] building permit has been automatically removed from the sharing [0:51:21] of the property to the new house. Section 2, exterior renovations, [0:51:25] repairs and improvements, sets board policy for lesser projects, the [0:51:29] requirement to get a building permit to repair or replace existing [0:51:33] structural features is eliminated. In other words, if you're replacing your steps, you don't [0:51:37] have to get a building permit from the association. [0:51:39] or renovations or repairs that require a program. [0:51:42] Building without approval and stop work orders has been reworked. [0:51:47] Right now, those fines are $500 for building without approval, $500 for stop work orders. [0:51:54] However, sometimes contractors keep building without approval. [0:52:00] So what the new rule, the proposed rule requires is that these fines will be daily. [0:52:05] In other words, if a contractor gets a stop work order and he continues to work or has [0:52:12] building without approval, that every day that work continues, the fine will continue. [0:52:19] Obviously, he stops working, he's fixing the problem, or let's say a property owner does [0:52:25] something without a permit, and that's one-time fine. [0:52:28] But if a person is deliberately continuing to work against the rules and without [0:52:35] getting a permit, then that'll be a continuous fine. [0:52:41] In other words, if some guy gets a stop work order, he's building for 10 more days, he's [0:52:45] got both a stop work order. [0:52:47] Progressing, not fixing the issue. [0:52:50] Right. [0:52:51] Yes. [0:52:52] I mean, anybody who gets a stop work order has to have work to fix the stop work order [0:52:56] problem. [0:52:57] But if they're continuing their project. [0:53:00] The roof's going on when they were told to stop at the footing. [0:53:03] Right. [0:53:04] So that will be a comparison. [0:53:07] That's a compounding fine. [0:53:07] It should be a real disincentive for people to continue to just blatantly violate our [0:53:14] rules. [0:53:14] And that has been a problem. [0:53:16] Under other related construction practices carries over relevant policy, the allowed [0:53:22] hours of outside construction activity have been slightly modified to be consistent all [0:53:27] six days of the week. [0:53:29] We used to have different hours for Saturday. [0:53:31] We just made it all the same. [0:53:32] And then also the proposed rules. [0:53:37] The rules also require property owners to authorize contractor gate access to the dwelling [0:53:42] live or go access program in the past. [0:53:45] A lot of times contractors were just bringing in a whole big list of people that they've [0:53:51] ever worked with, you know, 10, 10 electricians or something and asking our people to put [0:53:56] it in. [0:53:56] This is responsible of the property owners. [0:53:59] He's hiring a contractor to do work. [0:54:01] He gets them to access and that creates the direct link between the property owner and [0:54:06] the contract. [0:54:07] We also have a new section five, which I think committee and the staff is very excited [0:54:12] about complaints against contractors and our bylaws section 10 and our bylaws. [0:54:18] We are allowed to exclude contractors from the community if they're substandard, you [0:54:26] know, violating the rules, not, not paying attention. [0:54:29] So it creates a process where there's a preliminary review by the ARC committee, uh, notifications [0:54:36] of the contractor, a chance for the contract that I have a hearing with the ARC committee [0:54:40] to straighten it out. [0:54:41] And then, uh, if it's not satisfactory, then the ARC committee will make a recommendation [0:54:46] to the board. [0:54:47] The board will have to have a hearing with the contractor and then the board can vote [0:54:51] to exclude the contractor from the community or not. [0:54:55] So we can have better control of that. [0:54:59] Uh, as far as recommended impact fees, the, um, the new house building permit application [0:55:06] fee is being recommended at $150. [0:55:09] This is to have people have a little skin in the game. [0:55:13] If they're going to make an application, they've got some financial commitment to it. [0:55:16] The land disturbance fee of a hundred to a thousand dollars is eliminated because that's [0:55:20] all going to be included in the building permit. [0:55:22] Uh, garages currently at a hundred dollars are to be increased to a thousand dollars. [0:55:29] Moveovers and carports currently a hundred dollars be increased to $500. [0:55:34] Variances currently. [0:55:36] Variances currently $250 are to be increased to a thousand. [0:55:43] New house up to 1400 square feet currently is $1,200. [0:55:48] We're recommending $2,000. [0:55:50] New houses of $1,400 to $2,000 square feet currently $1,650. [0:55:56] We're recommending $2,500. [0:55:58] And new houses of $2,000 square feet or greater currently at $1,950 are increased to $3,000. [0:56:04] The boards can increase or decrease. [0:56:06] These fees. [0:56:07] And just to clarify you, that paragraph you just read what the fee schedule is for the [0:56:13] impact fees. [0:56:15] Yes, that's the construction impact. [0:56:18] When they, when they get their building permit, then they will pay the impact fee and construct. [0:56:24] So the architectural review committee request the following motion as proposed by the architectural [0:56:30] review committee to implement the streamlined new house building permit application process. [0:56:34] The board adopts the proposed. [0:56:36] Changes to article 10 of the rules in accordance with the emergency process, providing article 7, section 1 of the rules. [0:56:42] Additionally, the board approves the recommended changes to construction impact visas proposed by the architectural review committee. [0:56:49] But at this time, I'd like to ask the general manager and his staff to show the board and the people in attendance. [0:56:57] The new building permit process application online and how it works, Gary, just before you jump ahead. [0:57:05] I just want to ask one question. [0:57:06] Is there anything that I'm just trying to find? [0:57:14] I'm just kind of scanning over what they're what he just read at about construction site cleanliness. [0:57:22] Is there anything in there? [0:57:24] Because I look around and some of these construction sites look like the junkyard. [0:57:28] In the current one. [0:57:34] And we follow and abide by that. [0:57:37] In the new. [0:57:38] Process, I'm just going to make a suggestion that they have to check a box that there's a dumpster going to be on site instead of them piling it up in the in the edge of the woods and lighten it on fire and everything else. [0:57:52] A job site should be clean and orderly. [0:57:55] And and that and the rules under section for number six, it says property owners responsible for the property, proper health, safety and cleanliness of their lot during the construction process. [0:58:08] Including the proper and prompt cleanup and spills of dirt, mud and related construction materials, and if if necessary, we can add a dumpster requirement or something to the to the all temporary pictures should still be on your property, not across the street, not on the road. [0:58:25] Correct. [0:58:25] And if you want that added, just email us and we'll send it to Lauren to add it on the application. [0:58:31] So just add it. [0:58:32] We'll add it to the process anyway. [0:58:37] Go ahead there, Mr. [0:58:37] General. [0:58:39] Okay, at this point, I'm going to turn it over to these guys and you're going to show this is actually my staff. [0:58:51] So, Juliana and Sandy, Dave's also over here. [0:58:57] He's in the manager for this department, but they're going to go over this new process as well as, like, the way that we've set it up in Vantaca, which is going to be nice. [0:59:08] All of you as homeowners have access. [0:59:11] To Vantaca. [0:59:12] And so this process is just going to streamline, make it more efficient for us as the community and I'll turn it over. [0:59:21] If you were comfortable to stand over there by it while she's doing her. [0:59:35] Okay. [0:59:37] No worries. [0:59:42] Yeah. [0:59:44] You can see here. [0:59:45] This is a. [1:00:00] It's just a. [1:00:02] How the process is going to follow. [1:00:04] And I believe there's going to be a video afterwards to show you how to actually do. [1:00:10] Yes, you have to have a lot of information fee to complete all the required prepared and submit here. [1:00:31] It says complete application details that goes to your property owner information or property information or insurance. [1:00:46] We didn't have that before. [1:00:48] And we are information as well. [1:00:56] It's good to know. [1:00:57] You're going to use not just looking at. [1:01:02] Then you describe the project as we always have, but there's going to be a little bit more details to identify your construction site or square footage. [1:01:11] Your stories of the house or foundation exterior materials, driveway substrate anticipated. [1:01:18] So that we. [1:01:21] He said, she said, going through contractors. [1:01:33] This is all from the property owner throughout the entire. [1:01:41] Instead of going from between. [1:01:46] It gets a little. [1:01:47] Educated. [1:01:50] Yes. [1:01:54] Contractor. [1:01:57] This is the process where. [1:01:58] Understand some of the information that. [1:01:59] Yes. [1:02:00] They'll have to be in communication with each other. [1:02:01] Submit your full package, including your. [1:02:06] Your site plan, which is your survey. [1:02:07] Like an exhibit drawing. [1:02:08] The violence of surveyors. [1:02:09] Building plans. [1:02:10] Elevation. [1:02:20] 911 address. [1:02:21] Septic permit. [1:02:22] And then the other required erosion or drainage plan. [1:02:23] Most of me. [1:02:24] If you don't fill in all of the rules. [1:02:25] You're going to have to. [1:02:33] If you don't fill in all of the. [1:02:36] The plans, it will not be submitted to staff. [1:02:41] And we won't be able to review it. [1:02:45] So make sure that. [1:02:48] All fields are filled. [1:02:51] Next page for preparing for the lot. [1:02:55] This. [1:02:56] After you submitted the application. [1:02:57] If it comes. [1:02:58] To me or. [1:02:59] That maybe helping with that. [1:03:07] So these are the specific colors that. [1:03:09] Have to be laid out. [1:03:12] These were chosen. [1:03:13] Specifically. [1:03:13] property pins and signs. It's supposed to be front and back. Blue, home, decked [1:03:24] porches, patios, and detached structures. That will include, like, fences, maybe retaining walls, as well. [1:03:31] Green except for the same location. Yellow is for driveway entrances. That includes the entire length of the driveway, not just the entrance. [1:03:47] For communities, you can use a flyer. We suggest using string if you buy it on the property line. [1:04:00] The same game applies, however. The inspection may also have environmental protection or erosion control requirements. [1:04:20] That's for the . So, denied or denied pending additional information. [1:04:34] So, if that is required, it would still go to the committee. More information, this is basically your time. [1:04:50] You get 30 days, initially, as soon as you submit your application and we actually receive it. [1:04:55] It would be denied pending if there's additional information [1:04:59] or ... [1:04:59] may uh still need it uh if there is then once it goes to the committee uh the committee will [1:05:06] see that but if you don't get it within that 90 minutes of post we're going to meet you from the [1:05:43] road and that will make sure there is to your plan that means any movement you're going to move the [1:05:56] house to the other side uh you're going to change the location of your driveway that's going to [1:06:00] include a new 911 address this new time make sure you come in and amend it and let us know ahead of [1:06:08] time any movements will become a buy protect your property inspections so we are able to measure [1:06:29] correctly from the property line that means you're responsible for your contractors if your [1:06:46] contractors mess up and think that if your contractor to get it fixed it means that all [1:07:13] contractors that are being used also contractors you will obviously need to know their first first [1:07:21] names not just last names uh businesses are good too and you'll have to have the construction [1:07:31] as your [1:07:31] building permit is only going to be people related and the people mountains they've been [1:07:41] and the reports are good for up to a year um if it's not done within that time you will have to [1:07:47] reapply and go through the city responsible for either who is coming in so or visit running [1:08:07] around checking in every week one thing that i see constantly the damage to our roads yes [1:08:14] are directly due to these type of activities are you guys watching yes we are yeah because i can [1:08:21] get them right now [1:08:24] i mean the what's available now is not black and we want to protect not only the property [1:08:58] get the link if you have questions why don't we take if you if they're still here or send them [1:09:05] an email with questions we have a we have a meeting ma'am i also have common interest with the [1:09:13] this as well but at the end of the day it's getting late [1:09:17] so it's uh it's kind of i mean i'll definitely talk to you date but i mean i'm you know i'm [1:09:22] seeing more of that i don't know i don't have the kind of attention i want but it's super [1:09:28] you can uh just be as honest as you can uh i would say uh the my background is no one has [1:09:33] more interests particularly against areas like you know um you know any project [1:09:43] like uh [1:09:49] want to apologize about that but we we're having a problem with the link for the vantica to get it [1:09:54] to work tonight but what we're going to end up doing i was talking with my staff we're going to [1:09:59] actually record the process and how it works and we're going to post it to the website for [1:10:05] interested parties who want to to learn more about this process again our staff is always [1:10:12] going to be available to answer any and all questions on this but i know this is new for [1:10:17] everybody but you're going to have to be patient like as we go through this new process this [1:10:22] process is intended to make things easier to streamline it and i think it needs to go into [1:10:28] can we can we have one meeting here george george can we have one meeting people are talking and i [1:10:35] can't hear because everybody's talking around okay thank you mr president i would i would like [1:10:43] to add that given the opportunity the staff has based on [1:10:47] you [1:10:47] the board's concerns from last meeting the staff and the contractors that we invited into the [1:10:53] process were very excited about doing this they they knew all the problems that had been developed [1:10:59] over the years and given the opportunity to revamp this thing and address the problems and simplify [1:11:06] it the staff knew exactly what needed to be done the contractors involved exactly knew what needed [1:11:12] to be done the people who were dealing with this every day and i really want to commend the staff [1:11:17] commend the contractors who put their time in to create this new process so thank you again for [1:11:28] those who couldn't hear like we are putting this process into vantica which is your homeowner's [1:11:34] portal um we don't have an example to put up for you today because we're having little technical [1:11:40] difficulties however we're going to post a video about how it works on the website for any and all [1:11:46] interested parties again my staff will always be available in case you have any questions or any [1:11:51] questions comments or concerns on the process and we're always going to be there to help you [1:11:56] through it uh whereas we did it um via papers and in long uh different forms it's going to be more [1:12:04] streamlined so i look forward to it and thank you again to the staff for making it happen yes yes [1:12:09] right now this is actually we are looking into doing big product this is just for new homes [1:12:20] thank you i would like to make a motion first first off i'm not sure that's correct [1:12:32] because uh i believe we had agreed this process for was for anything garages extra stuff that [1:12:40] required a foundation we just need time to get it developed that's why currently [1:12:44] we are anyway i'd like to make a motion as proposed by the architecture review committee [1:12:49] to implement the streamlined new house building permit application process the board adopts the [1:12:55] proposed changes to article 10 of the rules in accordance with the emergency process [1:12:59] provided in article 7 section 1 of the rules additionally [1:13:02] the board approves to approve the recommended recommended changes to construction impact [1:13:08] fees as proposed by the committee also i need to add we need to repeal the building permit [1:13:13] process from the administrative policy manual which is also in conflict so anybody second my [1:13:22] motion i'll second it any discussion yeah uh this is graham i'd just like to ask you with [1:13:34] regards to the impact fees um are we in line with the remaining or the other [1:13:40] communities in the area in terms of the cost of the impact fees have we done a study it seems [1:13:47] low but i i just want to make sure we're we're in line or at least you know protecting our [1:13:55] investments there uh graham uh in the time constraints we had we didn't have time to do [1:14:02] that survey what that was recommended by the committee was what we thought was a conservative [1:14:07] increase uh that is long overdue [1:14:10] however the committee would be very happy to try to do that survey and bring some some revised [1:14:17] numbers back to the to the board at a future time no i i appreciate that i mean you know i i don't [1:14:27] know what they are in your areas but i've seen building impact fees in my area uh you [1:14:35] know upwards of 10 to 15 000 and maybe that's astronomical maybe that's out of line but [1:14:40] you know i certainly would like to see something uh make sure that we are [1:14:45] looking looked at as a premier place to build a career location increase um if we increase our [1:14:51] property values through that as well that would be awesome anything further you seconded gary [1:15:09] i made the motion you second second [1:15:12] approved without objection or do we need to vote approved without i want to thank the board for [1:15:25] the support for this because a lot of work went into this over the last 30 days to [1:15:30] have this whole thing so yeah i don't have any objection again um is the gate will we can we [1:15:41] charge the committee with going back and doing the survey and seeing where we're at the committee [1:15:47] will meet tomorrow and we'll start on that thank you very much gary okay moving to uh number nine [1:16:00] str fee moratorium update nick jackson actually i'm going to handle that for nick that's correct [1:16:08] gary you're going to handle that i just have to find got too many papers here uh we're proposing [1:16:21] a statement from the board of directors regarding the short-term rental fee. [1:16:28] during the meeting of june 12th 2026 the board voted to suspend the short-term rental [1:16:34] administrative fee pending further review current board understands that the short-term rental [1:16:40] administrative fee was intended to among other reasons compensate the association for the cost [1:16:46] of processing these tenants for access to our community since that time this review has been [1:16:52] canceled following an executive session during september 8th 2026 meeting the board determined it [1:16:58] would discontinue this fee the general manager and his staff will be making the transition to allow [1:17:03] property owners operating short-term rentals to register their tenants directly over the next few [1:17:09] weeks this is intended to reduce or eliminate the need for management to process short-term tenants [1:17:15] the board is aware that the elimination of the short-term rental administrative fee causes a [1:17:19] significant revenue shortfall [1:17:22] funding of our current budget. This will be addressed by the board in the coming months. [1:17:26] The $59 long-term rental administration continues to do the work needed to properly register these [1:17:33] tenants. And I would also remind the board that our attorney has weighed in that any short-term [1:17:42] rental property owner board member cannot vote on this. It's a conflict of interest and they are to [1:17:49] excuse themselves and leave the room or leave the Zoom. The vote can only be the non-short-term [1:17:57] rental property owner. Graham, Kurt, Nick, you all heard that, eh? [1:18:01] There only has to be two votes. Yeah, I heard. I don't know. I don't really think I agree with that. [1:18:12] That's advice from our attorney. No, the advice was you can do what you want. [1:18:28] Thank you, Matt. Thank you, Mike. [1:18:30] I don't know. I don't know. I don't know. [1:18:33] Happy to disclose. Obviously, I'm a short-term rental owner. I am the head of the short-term [1:18:37] rental committee. I'll happily excuse myself from this vote, but I am concerned with the... [1:18:46] We can chat about this more offline with the attorney. I know he sent the email just [1:18:49] 12 hours ago, so we don't have full time to digest it, but just wanted to make my point [1:18:53] made as well. Yeah, I'm sorry. You said we had to leave, right? Sorry. [1:19:02] I've been kicked out. Hello? Hello. Go ahead. [1:19:09] Oh, yeah. Sorry. I thought I saw a lost signal. This is Graham. So, yeah, just a [1:19:16] point of order here. I object to the commentary on this in regards to that. Again, I'm in line [1:19:25] with Nick that we've only had 12 hours to digest this. My concern is that there's a vested interest [1:19:33] of all owners, and I expressed that to the attorney. And when I did that, that fell [1:19:39] silent. And so I will remove myself from the meeting as the board has determined that I cannot [1:19:46] be in the meeting at this time due to my status as being a short-term rental owner, but I do want [1:19:51] my objection noted on record. Mr. President, I don't know the board's determined that. We're [1:19:58] just going by the advice of the attorney. And since there's so much concern about this, maybe [1:20:03] we table this until next month and have time to deal with it. [1:20:09] Again, I understand that the board's attorney, which we rely upon for opinions, has rendered [1:20:16] an opinion in this situation. And I'm willing to go along with this at this moment along with [1:20:24] the understanding that my objection is on record. And that's all I'll need to say. [1:20:33] I'm going to, this is Kurt. I'm also going to basically parrot what Graham said. So I have the [1:20:38] same mindset on that, but if it's, you know, we'll do what we have to do. And just let us know when [1:20:44] we can get back on. [1:20:44] Mr. President, I make a motion. We table this until next month where we can address this in a unified way. [1:20:53] We only need two votes. Whoever's left is. [1:20:58] Okay. I mean, they can't vote. They just said at their moment. So why don't we just move forward? [1:21:07] Move forward and put those. [1:21:08] Yeah, that's fine. I'm leaving. Just let me know when to get back on. I don't know how to do that. [1:21:14] Maybe just email or something. [1:21:16] I'll retract my. [1:21:16] Yeah. Text. We'll text you. [1:21:19] One guy said he's going to retract. Gary said he's going to retract. [1:21:22] All right. Sounds good. Leaving now. [1:21:25] All right. This is Kurt. I'm leaving now. [1:21:29] Oh, hang on. I'm trying to. Okay. [1:21:34] I feel like the vote's going to be secret. [1:21:41] Hold on. Discussion? Any discussion between us? [1:21:53] Yeah, I've got opting this motion or this. [1:21:56] This is Richard. I've got a comment. [1:21:59] A comment about this. I wasn't involved with this. It was the previous board. [1:22:05] Looking at it from the outside in, it was an extreme knee jerk reaction. [1:22:09] Thank you. I agree. [1:22:11] It was uncalled for. It was unacceptable. And the board failed the residents by doing that. [1:22:18] The data should have been produced to make a decision, and it was not. [1:22:22] That's correct. [1:22:23] Access should have data to back it up. And I'm just I'm not picking on access. But. [1:22:29] First service. [1:22:31] Yes. [1:22:32] Yeah. [1:22:33] I was involved with first services when it went from 39 to 59. And that was Gary Julian, [1:22:37] general manager, said, let's just raise it. [1:22:39] Yeah. [1:22:40] Malcolm Carter, the president, said, okay. [1:22:42] Yeah. [1:22:43] Nothing went into that. I was there. Tom was there when that was going on. So that's just [1:22:50] my comment outside looking in. But now I'm inside looking at it. This is a hard decision. [1:22:56] Yeah. [1:22:57] It's not easy. We've got 466, if I'm not mistaken, Amy told me, short-term rentals. [1:23:04] That's making money. We've got probably 2,700 residents that live here that are not short-term [1:23:14] rentals. Second home, full-time, retirements. How do you make a just decision, guys, that's [1:23:25] going to benefit everybody? You're not. [1:23:27] Well, I'm paying a fee for a long-term rental. There should be a fee for a long-term rental. [1:23:30] Yeah. [1:23:31] And see, that's one thing I agreed with on Tom. If I rent my home for a year, I pay 59 [1:23:37] bucks. If I rent it for the weekend, I still pay 59 bucks. [1:23:42] Every guest. [1:23:43] As a guest for nothing. [1:23:44] Yeah. [1:23:45] So this is a can of worms, guys. That's all I got to say about that. [1:23:52] Yeah. You know, I've got some, I mean, I see an impact, me personally, with short-term [1:24:01] rentals. [1:24:02] Which is? [1:24:03] Which is the pools, the gates, being backed up at busy season. I see the impact, the amount [1:24:14] of people. So to me, yes, it does make a difference. But again, there is no data. [1:24:25] No data. [1:24:26] To back up what they need to be charged. Or if they need to be charged. So how do you [1:24:33] vote on something that you don't have the information of? [1:24:38] You guess. [1:24:39] Oh, yeah. [1:24:40] And we don't guess. We want facts. [1:24:42] Yeah. Want facts. You should never. They sold that without the facts. So at the end of the [1:24:51] day, it's getting late. [1:24:52] They're going to. We're going to. I want to call for a vote. [1:24:58] I'd like to say something first. [1:24:59] Go ahead. [1:25:00] Here. [1:25:01] I think. [1:25:02] The $59 fee for long-term rentals, they're being processed every six months. They get [1:25:07] an ID card. There's work that the association has to do to process a long-term rental person [1:25:14] to be a tenant here. But with the short-term rentals, what does it cost the association [1:25:22] to have them be here? If we allow them to, if we allow the short-term rental property [1:25:29] owners. [1:25:30] First of all, I voted against the suspension when it happened, but to allow short-term [1:25:36] rental property owners to register their own guests. And I have to come back to the bylaws [1:25:42] and that we keep talking about section two article or article two, section eight. It [1:25:48] says any lot owner may delegate his or her right of use and enjoyment in the common area, [1:25:55] area of common responsibility or facilities, blah, to his or her tenant. If [1:25:58] we can't charge a user fee because they're the property owners delegating his right to [1:26:08] use the pool or whatever. So we can't get down into the weeds about how many people [1:26:13] are in the pool, how many times they come through the gate, because the bylaws basically [1:26:17] say that the lot owner is delegating that to his tenants. Now, if there's some cost [1:26:25] to the association to register. [1:26:27] To register these people like in the past, that's how we justified. It was never a gate [1:26:33] fee. It was never an impact fee. It was an administrative fee to process them coming [1:26:38] in. And if we allow the property owners to register their guests, then there's no extra [1:26:45] work for the association. And the bylaws, I think are clear that we can't charge a fee [1:26:52] for tenants. [1:26:53] But you have extra at the gate. [1:26:57] No, they're no different than the property owners. [1:27:01] Well, they have to go through the guest side. They have to go through the guest side. They [1:27:06] can't go through your property side. So you've got your gate backed up where they're either [1:27:13] having to call or they're having the attendant check them in. [1:27:17] But that's no different than any other guest. [1:27:20] That's correct. At the end of the day, they're given an access code. They punch it in the [1:27:25] computer. They use a QR code. [1:27:27] It shouldn't be a backup. [1:27:31] Let's get this done. [1:27:37] Can I add one little tidbit of information? I'm sorry, Ross, just a little bit. You are [1:27:45] correct that the owners will enter their guests. You have owners who we recognize about seven [1:27:53] management companies like Blue Sky, Mountain Resort, Mountain Oasis, Vacasa. I can't remember [1:27:57] all the rest of them. We enter all of their guest information into the system. [1:28:03] Then propose a fee for that work. [1:28:06] Okay. [1:28:07] To those rental agencies. [1:28:10] Yeah. Propose a fee. Well, I think we have to charge at the property owner. [1:28:14] Yeah, we can only charge the property owner. [1:28:15] If the property owner is a management company, we would have to charge at them. [1:28:17] But as far as just a blanket fee to run an STR to have your guests come in and out, I think the [1:28:22] bylaws are clear that you can't do that. [1:28:25] Neither of you live next door to a short-term rental. [1:28:28] So let's call the vote. [1:28:30] Okay. [1:28:31] What I have is a rental for five years. [1:28:33] Let's call the vote. [1:28:34] And a vote. [1:28:36] What's the motion? [1:28:38] The motion is to approve this statement that we're suspending or we're eliminating the STR fee. [1:28:46] I don't know if I understand that. [1:28:48] It's in your packet of stuff. [1:28:50] It's the very last page of the packet in the paper. [1:28:54] And this was sent out to everybody to review in advance way several months or several weeks ago. [1:29:01] It just reinforces their suspension. [1:29:03] It basically takes it. [1:29:04] It says there's no longer a suspension. [1:29:06] It's just gone. [1:29:07] It's gone. [1:29:11] We definitely need to call the vote. [1:29:13] Folks, folks, we're in the middle of a vote. [1:29:17] Mr. Stone Pfeiffer. [1:29:20] Yeah, you make me go first. [1:29:23] I live between two short-term rentals. [1:29:26] I see the troubles. [1:29:29] I've got a neighbor that's a resident. [1:29:32] It's hell on wheels compared to the short-term rentals. [1:29:36] I don't have a dog in this spot, guys. [1:29:39] So I don't know which way I need to vote to support it. [1:29:47] Yes. [1:29:48] Yes is in favor of this. [1:29:49] Yes is in favor. [1:29:50] In favor of the statement? [1:29:51] Yes. [1:29:52] Okay. [1:29:53] You're a yes. [1:29:54] Shirley? [1:29:55] Yes. [1:29:56] What'd you say? [1:29:57] Shirley, yes. [1:29:58] Yes. [1:30:00] Russ? [1:30:01] I'm the same, Richard. [1:30:03] Listen, I'm surrounded by STRs. [1:30:05] You are too. [1:30:07] I've had my run-ins with the STRs over several months. [1:30:11] Trash in my yard, loud barking dogs, smashing beer bottles. [1:30:16] I had to call the cops several times. [1:30:19] But at the end of the day, the amount of time I've invested in looking at this entire process [1:30:27] and the way it was developed [1:30:29] The downright misinformation, I'll call it straight out lies that I was told why this was brought in into this in twenty twenty one. [1:30:41] It was done illegally and therefore my vote is yes. [1:30:46] Leah, can I vote to not vote? [1:30:56] You can abstain because I mean, I just there are some things that I don't agree with. [1:31:02] OK, you can. I want to fall in the cracks or yes. [1:31:08] So it's one abstention. The statement will pass. [1:31:12] Passes. All right. Let him back in there. [1:31:16] I'll get it. Yep. I said, you know, the other three. [1:31:20] But I do think if we're registering people for a magic, yeah, we should be charging a fee for that. [1:31:32] It's not going to be a hundred thousand dollars. [1:31:34] So you're absolutely right. If there's a management company involved in there, they're not following using. [1:31:40] So their owners aren't involved in that. [1:31:42] And our staff's having to do it. [1:31:44] Yeah. Yeah. [1:31:45] We need to ask the same question. [1:31:48] If you if you look at and I'll open this because I'm very well involved in STR in the community and in the county. [1:32:02] If you have an issue with folks next door that it just so happens it could be your neighbor. [1:32:08] I don't care if it's an STR or not. Of course. [1:32:10] Dial 9-1-1 and tell them. [1:32:12] Bring an officer out. [1:32:13] Donnie, call them. [1:32:21] All right. [1:32:24] So soon as we get these. [1:32:26] All right. I got to get to the next thing on the agenda. [1:32:34] Treasurer's report. [1:32:35] Is Graham and all them back on now? [1:32:38] I sent him an email, so I'm not sure. [1:32:43] OK. [1:32:44] Number 10 is the budget process, financials and collection. [1:32:47] Mr. Stone's like. [1:32:51] Mr. President, I've got a document here. [1:32:53] I want you to see. [1:32:58] I'll be explaining this. [1:33:00] Shortly, but that way you can digest that first. [1:33:11] Let me talk about the budget. [1:33:16] I was a resident here and I stood at that podium and complained to the board that the numbers are bad. [1:33:23] The budget numbers were bad and were million dollars in debt. [1:33:28] I got the deer in the headlight. [1:33:31] I come back in May and said it again. [1:33:33] It's no comment. [1:33:36] No, nothing. [1:33:37] Frank looked at me and said, just it'll be OK. [1:33:42] I'm not an OK guy. [1:33:44] My Ross, I want facts. [1:33:48] So I thought to myself at that time, let me back up just a little. [1:33:52] Betty Reese was chairman of the Finance Committee. [1:33:55] My chair is now she come up to me right there and said, Richard, I want you on the Finance Committee. [1:34:02] The knowledge you have in this place and how it runs is invaluable. [1:34:06] I said, Betty, I will help you. [1:34:07] I put in an application that day. [1:34:11] Frank Darryl rejected it. [1:34:14] Thank you. [1:34:15] Pardon? [1:34:16] You rejected me being on the Finance Committee. [1:34:18] I had no I had no standing to reject her. [1:34:21] I'm telling you what I was telling you. [1:34:23] Come on. [1:34:23] Let's just tell you what I was told. [1:34:26] Let's keep this. [1:34:26] So at that time. [1:34:28] My officer training kicked in and I thought something's wrong with this picture. [1:34:35] I can't fight it from out there. [1:34:38] I've got to get in here. [1:34:40] That's why I run for the board. [1:34:42] I started digging. [1:34:44] Our first board member was September, whatever it was, first week in September. [1:34:49] That day, I got access to the computer system that give me real time information on banca. [1:34:58] I ran a report and I was right. [1:35:03] I immediately sent. [1:35:04] A. [1:35:06] Access management. [1:35:07] Top controller. [1:35:08] Michelle emailed. [1:35:09] I tagged Ross in it so he would know what I was doing, asking her why her numbers are [1:35:16] negative and ours are positive. [1:35:18] She said, we need to Zoom meeting immediately. [1:35:20] We had a board meeting on Tuesday, Zoom meeting Friday with me, Leah, the general manager. [1:35:29] And I asked her, I said, Michelle, you've been with us for three years. [1:35:33] What's wrong now? [1:35:34] She said, it's the budget. [1:35:36] They submitted a fraud budget. [1:35:37] I said, what's wrong now? [1:35:38] I said, how? [1:35:39] Tell me how they've done this. [1:35:40] I said, they submitted a budget that's $1.3 million over in expenses than income. [1:35:52] I said, you can't do that. [1:35:53] She said, exactly. [1:35:54] This is driving us crazy. [1:35:55] We have managed 133, and that's why I know that number, properties, and we've never seen [1:36:01] this. [1:36:02] I said, well, how do we fix it? [1:36:03] I said, if it's a problem, we can fix it. [1:36:05] She said, you've got two choices. [1:36:06] I said, you've got two choices. [1:36:07] You amend the budget, a special assessment. [1:36:08] That's a four-letter word. [1:36:09] We don't wanna pay more money for mistakes. [1:36:10] So I started digging a little deeper. [1:36:13] How did we do this? [1:36:16] She said, when they first submitted the budget, Richard, and Ryan and Leah can attest to this, [1:36:30] they submitted the original budget with dues of 1,400 and some odd dollars, which is $1,080, [1:36:36] and they would raise it to 14-something. [1:36:38] unacceptable no way in hell should we ever pay something like that ross thank you come in here [1:36:49] and said no ain't happening 10 40 greed where they messed up at didn't change the numbers [1:36:58] they didn't change the numbers the budget now was that intentional or is that stupid it was [1:37:06] uh an oversight that was an oversight if you recall at that time the condition is [1:37:13] is we need to amend this budget because we're going broke and i'm fixing to give you some [1:37:17] numbers to show you that all right well first and foremost i have no authority to [1:37:25] assign or remove people from the finance committee that is that is the president [1:37:32] the chairperson of the finance committee so you're wrong categorically [1:37:36] wrong in regards to that allegation number number two the uh budget frank let me finish [1:37:44] what i'm saying please oh i'm sorry i thought you were finished no sir i got a lot to say [1:37:50] uh as everybody's noticed our capital contribution what is it what's your [1:38:02] ultimate point we need to amend the budget [1:38:07] do we know what i mean everything was messed up from 2022 [1:38:13] and we're still trying to figure it out to where we actually are with the budget i disagree with [1:38:21] that well i can show you all of them i can show you anything you want i'm going by facts that [1:38:26] access gives me they're wrong they were right for three years when we were completely wrong [1:38:33] this is wrong [1:38:37] richard this is graham when when we initially came in yes you're correct it was a there was [1:38:44] a 1400 assessment um we made the motion i believe i actually made the motion to to limit it to 10 [1:38:51] percent um and that was carried we did adjust the budget in the meeting on the fly on the [1:38:58] spreadsheets now what got communicated to access i am not sure of but i can tell you that we had cut [1:39:07] out the additional 10 percent um overage out of that budget i believe it was 22 percent if i'm not [1:39:13] mistaken we cut out the additional 12 percent we did that on the fly on the spreadsheets with with [1:39:20] amy and with um bob hazard and that was done by cutting out i believe if i'm not mistaken 187 [1:39:29] thousand dollars of of road repairs um and there was one other line item that i can't recall off [1:39:35] the top of my head but a majority of the budget was cut out and we did that on the fly on the [1:39:37] of it came from eliminating um capital roads um gravel to you're 100 correct i was there i [1:39:48] witnessed it unfortunately i think there was some internal errors so when the adjustments were made [1:39:55] it didn't didn't all fully come down through the budget uh spreadsheet so a line item adjustment [1:40:02] was made but the formulas didn't take it down to the [1:40:07] bottom lines uh and i'm pretty sure that that's 100 been identified by uh uh access now talking [1:40:17] with them uh two weeks ago that they have identified the formula errors where the numbers [1:40:23] didn't all flow through the spreadsheet correctly so you are 100 correct we did take it out [1:40:29] unfortunately the bottom line figures that stayed stayed and we're dealing with a fraudulent [1:40:37] budget we're dealing with an uh a budget that is not accurate incorrect that's fraudulent [1:40:45] fraudulent is a terrible word i don't know why you're using it richard and and i take [1:40:51] of that it was it was fraudulent means it was an intention to do something and nobody intended to [1:40:59] submit a fraudulent budget it was with all good faith that the budget was amended and there was [1:41:05] an error in the final totaling [1:41:07] uh final numbers and that should what should be reflected here upon the record [1:41:12] not that a fraudulent budget was submitted thank you let me move on here and i want uh [1:41:19] mr darryl to explain something to me this is uh like i say your number is not mine [1:41:25] last september you submitted uh operating cash at 6.4 million dollars [1:41:32] then on the very next page it says operating cash is 4.6 million dollars [1:41:38] i don't know if you inverted it by accident or included reserve and operating or whatever but [1:41:44] uh that's a problem to me because numbers have to add up also while you're looking for that [1:41:53] we started this budget on may 1 may july august four months our reserves have stayed at 1.7 [1:42:01] million dollars uh and i questioned that because frank on september 19th you sent an email that said [1:42:12] that uh there's 400 there's 739 thousand dollars in operating funds to be transferred has that [1:42:19] been transferred no that has not we're still in process of trying to verify those numbers in fact [1:42:25] some of the numbers we have came that you enlightened us in the executive session because [1:42:33] we cannot find the minutes i have not found them at this point in time showing that the board had [1:42:39] had made any motion to move money [1:42:42] surplus money into the budget we've got a lot of disconnects that have happened from [1:42:46] 2020 from 2022 up until present we are working like uh we we are working [1:42:57] innumerable hours trying to repair [1:43:02] faulty finance i'm not going to say fraudulent because i don't see any fraud i don't see any [1:43:11] that wasn't mean words i apologize guys for you [1:43:13] but but what we have are just totally financial statements that are just contrary to gap [1:43:24] and i i'm not going to opine as to how we got into this condition but i'll when i get into my [1:43:30] presentation i'll i'll enlighten the general public those that are on the phone what have you [1:43:35] as to where we are going but we've had we've had to clean up a mess an absolute mess and i'm not [1:43:42] blaming anybody uh in regards to this it just [1:43:46] happened and i think you look at the numbers now we're in a mess it's horrible that's what that's [1:43:52] what i've been preaching since february and it's falling on deaf ears okay let's um yes it is i [1:43:59] understand me i understand it was it was a mess that we were handed uh one when we took over and [1:44:08] we have been diligently working to correct all the all the factual errors that have been [1:44:16] committed against us to get together to our [1:44:43] financial statements from our last audit up until present during my two years as president are pretty [1:44:46] the treasurer transferred money from general capital reserve every month let me get let me get you yeah here you go thank you michael i got a report every monday of everything the general manager spent money on it all right they don't talk about it and we will tell you three days later the chairman of the compton reserve council sent several money to our record and hospitalis. tutti channels were shootin money to our fertility local insurancegiving all that and therapists many culture [1:44:48] So when did you get the audits done? [1:44:51] Did you get an audit done the entire time? [1:44:52] This ain't got nothing to do with it. [1:44:53] We can talk about that later. [1:44:55] Because the audit was screwed up in 21 by Marvin Chance because he didn't have accurate numbers. [1:45:01] I spoke with him on the phone. [1:45:03] That is true. [1:45:04] He said, I can't give you an audit. [1:45:05] The numbers ain't there. [1:45:06] What did you do about it? [1:45:08] Can I make a suggestion here? [1:45:10] Because this is just going to go on. [1:45:12] Listen, this is just going to go on. [1:45:14] Can we all say that we're going to get together in the next week or two, okay, to iron this out so that we can either fix this budget? [1:45:31] Because this, I mean, right now, this is just. [1:45:34] There's no answer to this. [1:45:35] Well, the fix on the budget. [1:45:37] It's better that we all sit together and look at this, put our heads together. [1:45:42] We're all smart. [1:45:43] Let's put our heads together. [1:45:45] Let's get the conference room. [1:45:48] Let's sit there. [1:45:49] Let's go through. [1:45:51] I mean, believe me, if I go through that spreadsheet one more time, I'm going to go crazy. [1:45:57] Are you making a motion that we have a workshop? [1:46:00] Yeah. [1:46:01] They're a mess. [1:46:03] We got to take that spreadsheet, and we got to tear it apart. [1:46:10] We've already fixed this already. [1:46:12] Yeah. [1:46:13] So, I'll second your motion, Ross, that we have a workshop to examine all these concerns. [1:46:20] Yes. [1:46:21] Are you going to call the date, or you want to fix the date now? [1:46:25] Why don't we. [1:46:31] Sooner than later. [1:46:32] I may want to take a trip to Vermont. [1:46:35] Let's do it. [1:46:36] Let's do it next week. [1:46:39] 19th, I've got a meeting with the IRS. [1:46:42] So, let me just look at the calendar real quick. [1:46:47] This is already the 13th, 19th, let's say, do you want to do it on the 22nd, Richard? [1:46:58] 9 a.m. [1:47:02] Yeah, I'm ready. [1:47:03] Do it. [1:47:04] 9 o'clock? [1:47:05] Yeah. [1:47:06] Ike, are you willing to be available at that time? [1:47:07] I think so. [1:47:08] I'll get back to you. [1:47:09] Could I recommend we do it on the 23rd, please? [1:47:10] 23rd? [1:47:11] Boy, you're getting me back. [1:47:12] All right. [1:47:13] What do you mean, the snow season? [1:47:14] Me too, actually. [1:47:15] The 23rd would be better. [1:47:16] It's a Friday. [1:47:17] I can work that. [1:47:18] Okay. [1:47:19] All right. [1:47:23] 23rd. [1:47:24] The motion's been made by Ross, seconded by me, that we conduct a board workshop to [1:47:30] examine concerns regarding the budget and collections on the, pardon me? [1:47:38] The budget irregularities. [1:47:39] Yes. [1:47:40] On the 23rd of October, 9 a.m. [1:47:42] Now, in a workshop, it's not going to be open to the public, but we cannot make decisions. [1:47:48] We can just study the problem. [1:47:50] We need to. [1:47:51] We all need to get our arms around it. [1:47:52] All right. [1:47:52] Thank you. [1:47:56] We need to study the problem. [1:47:57] It's the 3rd of October? [1:47:58] Yeah. [1:47:59] Well, let me finish my thing, and then on collections. [1:48:02] During the, Mr. Fernandez was involved, back when Malcolm Carter, all he was doing was [1:48:10] talking about collections. [1:48:11] Talk, talk, talk. [1:48:12] I asked Malcolm Carter at the time, rest his soul in peace, all you're doing is talking [1:48:18] about this. [1:48:19] You care if I look into it? [1:48:20] Sure. [1:48:21] I started the collections, made tons of money, kept our budget up. [1:48:31] During that conference call, he was there. [1:48:34] I asked Michelle about our collections, and she said Susan Dorr stopped them in August. [1:48:42] They've never been started back. [1:48:44] Gary, you was president last year. [1:48:45] Why did the collections not start back? [1:48:48] It did start back in October. [1:48:50] Well, yeah, we started collections through our attorney. [1:48:53] No, I mean real collections, not legal collections. [1:48:56] What kind of collections do you say are real? [1:48:58] Access. [1:49:00] You want access to call everybody? [1:49:02] Okay. [1:49:02] Yeah. [1:49:03] My last year made over $1.1 million. [1:49:07] Get the money coming in. [1:49:09] And what did that cost us? [1:49:12] Uncollectible, unrecoverable costs. [1:49:15] I can't hear you, Frank. [1:49:16] How much did that cost us in unrecoverable? [1:49:18] 20%, which we didn't have to pay. [1:49:23] We were required to pay according to the agreement, [1:49:26] but legally. [1:49:27] That should have been the homeowner's cost. [1:49:30] The reason, just as a comment, and I'll stand down, [1:49:33] the reason it was stopped in August is because Susan Dorr called me and said, [1:49:38] Richard, they're collecting money on 90-day debt on dues. [1:49:44] So the dues is $1,080. [1:49:46] They're just getting $200 of it. [1:49:49] So people, that late, they're going to pay up front real quick. [1:49:53] So we decided we're stopping this. [1:49:55] We need to go to a 24-month period. [1:49:59] And Mike has championed our collections efforts, [1:50:03] and I'll let you address this, Mike. [1:50:05] Well, I mean, we're negotiating right now with Access to get that back on track. [1:50:11] At 20%, at the 90 days, it's the exact same thing that you signed up for. [1:50:17] They stopped it before I got on. [1:50:19] But we've added a lot of transparency that wasn't there before. [1:50:23] There was no transparency whatsoever with the collections process that we had, [1:50:28] in place. [1:50:29] So what we've done is we've improved that, and Access is agreed to everything. [1:50:34] Okay. [1:50:35] So we're in good shape on that. [1:50:36] And one of the big differences we have here is that 20% cost belongs to the past due property owner. [1:50:43] It's not a cost that we eat. [1:50:47] So, yeah. [1:50:48] It's under collection. [1:50:49] So if they owe us $1,000, Access collects $1,200, we get our full $1,000, [1:50:57] and they collect it. [1:50:58] And they collect it. [1:50:58] And they get their 20% from the property owner. [1:51:00] It was the other way around. [1:51:02] We were eating all that cost before. [1:51:04] That's a good deal. [1:51:05] Yeah. [1:51:06] I mean, we've been slaving over the state for 90 days. [1:51:11] Thank you for starting that back. [1:51:12] Yeah. [1:51:13] A dollar is a dollar. [1:51:16] Two is even better. [1:51:18] I'll tell you something about it. [1:51:19] You need to call the motion, the question, and vote on the motion to have the workshop. [1:51:24] Yeah. [1:51:24] Okay. [1:51:25] All in favor of the workshop? [1:51:27] Yeah. [1:51:27] All in favor of the workshop? [1:51:28] Yes. [1:51:28] Aye. [1:51:29] But I'm going to let they go. [1:51:30] Nick, Graham, Kurt. [1:51:33] Yes, from Nick. [1:51:34] Yes, from Kurt. [1:51:35] Keep on the phone. [1:51:38] Yes, from Graham. [1:51:43] Passed unanimously. [1:51:46] Next is deer management, Mr. President. [1:51:49] Whoops. [1:51:49] No, you forgot? [1:51:50] Deer management. [1:51:52] Director's report. [1:51:53] Sorry. [1:51:54] You're trying to cut me. [1:51:54] Director's report's number 13. [1:51:56] 11 is deer management. [1:51:57] Okay. [1:51:57] 12 is steps to the river. [1:52:05] Where are we at? [1:52:06] Deer management. [1:52:06] 11, deer management. [1:52:08] Deer management. [1:52:09] Just FYI, I just wanted to bring it up. [1:52:12] USDA, Mike Fulgram contacted me, and we're awaiting a report from the USDA. [1:52:20] The gentleman from the USDA came in, I think it was last Tuesday, and is reviewing the [1:52:28] deer population issue once again. [1:52:32] This gentleman just so happens to be the one, and I believe it is in Fulton County. [1:52:38] Where they're doing a deer population control. [1:52:47] So, we are waiting to get this gentleman's information. [1:52:54] That's all I know at the current time. [1:52:58] I'm sure Mike will share that report with all of us. [1:53:02] Steps to the river. [1:53:04] Dave, still here? [1:53:06] Sir? [1:53:07] Any word? [1:53:07] Back from the Department of DEP? [1:53:11] No, sir. [1:53:12] I'm going back to Fort Lauderdale. [1:53:15] I'm not going to touch it until I get something back from the state telling me that I can progress [1:53:19] with it, with what had happened. [1:53:23] I put them down. [1:53:24] We didn't know if we had to have a variance. [1:53:27] I've not been told that I needed one. [1:53:28] I've not been told that I had to have one. [1:53:30] So, I'm just waiting on the EPD to get back with me from Gilmer County. [1:53:35] Could we just maybe reach out to them? [1:53:37] We can, but I mean, I'm just going through code. [1:53:42] I know. [1:53:42] I think the guys that were here, they said that they don't actually make the decision [1:53:45] as you go up to the... [1:53:46] That is true. [1:53:47] And I did speak with that guy as well. [1:53:49] And he was supposed to get back with Art. [1:53:51] And Art was supposed to get back with me. [1:53:53] But, talking to Art, he's not heard nothing. [1:53:57] So, I physically don't want to touch anything down here on the river. [1:54:00] I would just say, why don't we... [1:54:03] Somebody just called it. [1:54:04] One of those guys that was on site. [1:54:06] I'm calling him, Art. [1:54:07] Just checking in, you know, what do you want us to do? [1:54:12] I just don't want to see the erosion at... [1:54:15] No, like I said, I mean, Art told me I could go ahead and stabilize what we got in. [1:54:20] But, again, I don't... [1:54:24] Short up, and then have to turn around and go my manner. [1:54:31] George, EPD is saying that I was good to go. [1:54:33] He may have to go to his superiors. [1:54:36] But, I have a card for one of the gentlemen, and we'll follow up with him tomorrow. [1:54:43] Okay. [1:54:43] It's just amazing how long stuff takes to get done. [1:54:48] Yeah. [1:54:56] Treasurer's report. [1:54:57] All right. [1:54:58] Treasurer's report. [1:54:59] I've got a few general points to talk about first. [1:55:06] We're changing... [1:55:09] In fact, I've already spoken in the executive session, so this is mostly for you folks. [1:55:14] But, we're changing how we approach our finances. [1:55:18] Historically, we have... [1:55:22] I can't give you a reason why, but we have not allowed access management to take on the burden of our financial reporting and the like, [1:55:32] even though we pay for the service. [1:55:34] In fact, I think it was 24, they were uninvited from even reviewing our financial statements. [1:55:41] So, we're changing that. [1:55:43] Now, all our financial services are going... [1:55:48] We're going to be conducted by access management, and we'll come under the scrutiny and review of the Finance Committee and the Treasurer. [1:55:56] We have worked for the last many, many months, shoulder to shoulder with access management, [1:56:03] and under the watchful eye of our auditor, to correct financials. [1:56:09] And, we've had to go all the way back to the last audit to try to correct all the financial statements from 22... [1:56:17] 23, all the way up to current, so that we can get our audit completed. [1:56:22] So, we are in process. [1:56:24] I hope to have our first audit in many years before our next board meeting. [1:56:32] We have an IRS audit that has been a shadow over our head for quite a while. [1:56:38] We have our first meeting, appeal meeting with the IRS this coming week. [1:56:47] I can't tell you how that's going to play out, but I will give you information on that as we learn it. [1:56:54] We have also, not only have we turned over our financial, the financial responsibilities to access management, [1:57:03] they're also taking the lead on our budget. [1:57:07] And, we're going to get out of their way and then work in a review capacity, going to expect input from all the Board of Directors, [1:57:16] FAR, [1:57:17] in advance of us having to vote on it, the next time the budget is presented. [1:57:24] So, and the other thing I'm asking access management to do is to take over the now required annual review of our water rate. [1:57:35] That is a contentious subject because nobody is going to trust anybody within this board structure to do, [1:57:46] to do a fair and balanced. [1:57:48] It's not saying that there would be anything but fair and balanced, [1:57:53] but in order to give arms length review and recommendations, [1:58:01] we need to offshoot that to access management to have them give us that recommendation. [1:58:06] Now, [1:58:09] Grant hates me because I'll take the microphone with me, [1:58:14] but we'll go to, [1:58:16] this report for this crowd that we have, [1:58:21] this is the design of the bill. [1:58:24] So, we're open to suggestions. [1:58:40] This is a report that is paragraph five records and access management. [1:58:49] So, this is independently by our finance committee. [1:58:57] Let's go to the first slide. [1:58:59] This is where our cash, [1:59:18] our cash investments are 5.95 million. [1:59:21] We're under budget. [1:59:22] Our total spending by 287,000 3 million in every day operations, [1:59:47] 1.76 and major repair savings. [1:59:52] Some more modest amounts that are in the bill is in large. [2:00:03] This is where it gets a little more exciting. [2:00:05] We've got 2.97 million. [2:00:08] These are idle funds. [2:00:11] And we are split between Edward Jones and Merrill Lynch. [2:00:15] Merrill Lynch is our operating, [2:00:18] surplus that we've been spending through the course of the year. [2:00:23] Edward Jones is for our reserve and capital expenditures. [2:00:28] Next slide. [2:00:45] Five and a little better in September. [2:00:48] You see these, [2:00:54] $2,000 per month. [2:01:06] That's good. [2:01:19] 3,000, all right, that's good. [2:01:37] Administrative 284. [2:01:39] We're at 260. [2:01:41] That's good. [2:01:42] Contracts, 119,000. [2:01:43] Actual 105. [2:01:44] That's good. [2:01:45] Repair and maintenance, 134,000. [2:01:46] And our actual expenditures, $97,000. [2:01:47] We're really tight. [2:01:48] We've got a couple of really hiccups, [2:01:49] that are really going to put some pressure on us as we're going forward. [2:01:50] Very hard to control these. [2:01:51] Okay. [2:01:52] So, and this is, [2:01:53] this is where our, [2:01:54] our, [2:02:56] You know, so these are the main projects that we have finished painting, our sports courts. [2:03:05] We've had some urgent repairs, and our gate upgrades are about half done, but we're still working on our first ideal structures. [2:03:26] Our backup generators are being placed in the right center of the board house, and we have inspections going on. [2:03:35] It's also involved in a lot of other things. [2:04:01] I do want you to know that by design, that is in every other site. [2:04:05] Our accounts, we've got to reconcile our reserve accounts. [2:04:16] We've missed some steps historically. [2:04:19] Again, this is all part of our accounting collections of the Falkland County, which ties in with our real estate books. [2:04:30] We're digging up what's next. [2:04:32] We're going through. [2:04:33] And we're going through. [2:04:37] Fair Collections spoke to that just briefly about our collections program. [2:04:44] And we expect to see some great things coming from our products underway, and they're in the last. [2:05:18] Our next budget, the owners are starting to weigh in. [2:05:24] Access management is driving that bus now. [2:05:27] We want to get you ready to put your feet back. [2:05:49] And we're going to get you ready to move forward. [2:06:42] Do you have any thoughts about the future? [2:06:45] I think that's a good question. [2:06:46] I think it sounds like our project is going to be a little bit more ambitious than your expectations. [2:06:49] We're going to be completely focused on making sure we can get the bus to where it's going. [2:06:55] But we're going to have a lot of things. [2:06:57] A lot of things we're planning to do. [2:06:59] We're going to have to see if we can get some of the materials, the materials that we think we're going to need to actually go out there to get the bus there. [2:07:05] Are you in a hurry? [2:07:06] budget uh doing those capital items um we also said earlier that we would ramp up uh this past [2:07:15] summer uh the spreading of millings uh dave and his team has been doing that and i'm happy to [2:07:20] report that we've now um surfaced with millings um maybe not complete roads but we've done 98 roads [2:07:28] to date um and i'm really proud of the staff and want to thank them for that um the outdoor [2:07:35] pools have been closed and we've covered them the foxtown and riverside pools [2:07:40] i want to thank the pool and maintenance staff and everyone that made that happen [2:07:45] we've done the enclosure or finished with the renovation to the enclosure to the rec center pool [2:07:51] we opened last friday back open i hope you can all come and enjoy and see the improvements that [2:07:57] we've done and we do have capital plans to do the interior uh pool area which fell to the wayside [2:08:05] with the uh the uh the uh the uh the uh the [2:08:05] previous boards like trying to get that accomplished due to uh contractors not being [2:08:10] able to uh muscle through and finish that but we do have plans to try to finish that this next [2:08:15] year capital wise um we had two of note um that i have to report in this meeting uh emergency [2:08:22] septic repairs one is for the water tower and the other was for the uh little what we call the [2:08:28] little e villas um the water tower uh cost and this is what we've seen all around camp [2:08:35] campus uh this goes to the fact that we just have an aging infrastructure uh the water tower [2:08:41] repairs uh to the septic system were 42 250 and then we had to uh repair the little ease which [2:08:49] are near fife bridge their villas near the fife bridge that was 54 940 to restore both those [2:08:55] septic systems for our common areas that get use um which is one that's included in the building [2:09:02] we're in today um then we've also been able to repair the septic system for the water tower [2:09:05] we've also uh replaced the generators uh at both the rec center and the miller house those are now [2:09:11] operational um we did fall within budget on those and they are now installed uh dave's been a busy [2:09:18] man um we have also re-established and i apologize it took so long but we had several [2:09:25] different uh failures not just the first street bathhouse alone but the first street bathhouse [2:09:30] been closed for some time that is now reopened uh we will monitor the [2:09:35] hours on that we're trying to do uh six to eight so that it could be utilized and then um [2:09:41] um we will have or be monitoring that but that is back open um [2:09:47] to read into the minutes and i talked about this earlier the adult community room at the riverside [2:09:54] pool um we announced to the community on the 24th the board decided not to move forward with [2:10:00] the proposed adult only community room at riverside pool and the plan to open house um the [2:10:05] house sessions were canceled the board considered advice from our association's legal counsel [2:10:10] concerning potential age discrimination concerns liability exposure and safety risk related to the [2:10:17] unsupervised space we appreciate the homeowners who expressed interest and shared ideas for this [2:10:23] proposal ultimately the decision was made to protect the interest and safety of the associations [2:10:28] and its membership um i also want to thank everybody uh i know there were some [2:10:35] issues with the the parking lot that we had to close and we were also [2:10:38] unable to have any parking places open in the parking lot so we did have to cancel the parking [2:10:43] space appointment but we did have to cancel this past weekend the picking on the porch [2:10:48] um we did have the hurricane that came in and uh we were advised and and we're taking direction from [2:10:55] uh the gilmore county emergency emergency management uh again i know that wasn't an ideal [2:11:01] uh but we also want to err on the side of safety of everyone so thank you for everybody [2:11:04] My staff and Dave, I mean, he's been busy, busy on many of these road millings, repairs around the community, and he's really been making quick work of it. [2:11:15] I also want to thank, you know, Amy, the ARC staff coming together and putting a plan together so that we can better simplify the building process here in Kusawati. [2:11:26] And again, I want to thank everyone for wanting to improve Kusawati and make it better. [2:11:32] It really is, in the one and a half years that I've been here, it really has improved, and I want to thank everyone for that, including this board. [2:11:41] So, thank you. [2:11:46] Okay. [2:11:47] Thanks, Ryan. [2:11:49] Board member remarks? [2:11:51] Richard? [2:11:52] Start with me again. [2:11:54] You're on my right. [2:11:59] First, I want to apologize to Frank about using the word, what was it? [2:12:05] Fraudulent. [2:12:06] I apologize, sincerely. [2:12:08] It's inappropriate. [2:12:09] Inappropriate. [2:12:09] Shouldn't have been said. [2:12:11] Nothing more needs to be said. [2:12:12] We're good. [2:12:13] We're all here for the same reason. [2:12:15] We need these numbers right. [2:12:17] I feel confident, and Mike, the finance committee, stirring with the treasurer, and until those reports matches Frank Darrow's number, I'm not going to be happy. [2:12:34] That has to happen, guys. [2:12:36] You understand? [2:12:38] Because. [2:12:38] This number has to match this number, and if it don't, it really looks bad. [2:12:43] So, I'll end it on that. [2:12:45] Thank you, Mr. President. [2:12:48] Mr. Padgett? [2:12:51] I just want to say thanks to everybody. [2:12:53] I appreciate everybody on the board and all their help. [2:12:57] We are going to get the books right. [2:12:59] The books are a mess. [2:13:01] The budget's been a mess, and we're going to fix it. [2:13:04] We've had to go back a number of years, and it's just a lot of work. [2:13:08] We're pretty much working around the clock. [2:13:10] We're working around the clock to get this right, and we're all on the same page, and we all want the best for Kusumati. [2:13:18] That's right. [2:13:18] Thank you, Mike. [2:13:20] Ms. Farley? [2:13:21] Nothing to say. [2:13:25] Are you Godfrey? [2:13:30] Push that button, girl. [2:13:32] Actually, it's green, so I don't think I have to push it. [2:13:35] I've got the timer on you. [2:13:36] Uh-oh. [2:13:39] Brian, I want to make sure that you do have it on your list. [2:13:43] The Riverside Pool, the... [2:13:45] It has to be fixed before it's opened next year, so we don't have to get it. [2:13:53] They are aware, but even this year, we couldn't get in there and do that, because it would have required draining the whole pier. [2:13:58] Right. [2:13:59] I just want to make sure that it is on the agenda the day before it's time to open it up. [2:14:09] I'll make sure we address that before we open the pool. [2:14:12] Okay. [2:14:14] Thanks, everybody. [2:14:15] I think we're all trying our best. [2:14:19] To work together. [2:14:20] To move through the body of the board. [2:14:23] But I don't know when to say it, so I'll have to wait and ask. [2:14:29] Gary? [2:14:30] I have nothing. [2:14:31] Thank you. [2:14:32] Nick? [2:14:34] I just want to say thanks for the board to, you know, trying something unique within a later meeting time tonight. [2:14:38] I think it's encouraging to just, you know, try to get owners more involved and try different things. [2:14:42] Maybe it worked, maybe it didn't, but I do appreciate, you know, everybody being flexible and trying this out. [2:14:50] Graham? [2:14:51] Graham and Nick... [2:14:52] Graham and Kurt both jumped off. [2:14:53] They left. [2:14:53] It's up to me. [2:14:55] Yeah. [2:14:57] One thing I just realized, I found a piece of paper in front of me. [2:15:01] Committee appointments, October 13, 2026. [2:15:05] We have four folks listed. [2:15:07] We addressed that. [2:15:07] We addressed that, yeah. [2:15:09] We did? [2:15:09] Yeah, we just... [2:15:10] Yes, please. [2:15:11] The STRs. [2:15:11] The STRs until next month to figure out membership. [2:15:15] Well, I'm... [2:15:16] And we approved... [2:15:17] The only reason I'm asking is I have four people that are on this list. [2:15:21] And... [2:15:22] Yes. [2:15:23] Not all STR owners. [2:15:25] One of them is not. [2:15:27] Okay. [2:15:28] So... [2:15:28] We still have... [2:15:29] Yeah, they're balanced, though. [2:15:30] I was under the impression all of them were, but we've tabled those for next month and [2:15:35] let's come back with something. [2:15:37] That's it for me. [2:15:42] Listen, it's been a long day. [2:15:45] I mean, there's a lot. [2:15:48] We've been here before 3 o'clock today. [2:15:51] I'm actually kind of glad we put this at 3 o'clock because I could see we would be past [2:15:57] midnight. [2:15:58] Mm-hmm. [2:15:59] So, thank you, everybody, for coming. [2:16:00] Thanks, everybody, for coming. [2:16:01] And I'm... [2:16:03] Motion to adjourn. [2:16:05] Our next meeting is... [2:16:06] Saturday. [2:16:07] November 14th at 9 a.m. [2:16:08] Saturday, November 14th at 9 a.m. [2:16:09] Yeah, we were doing one of each. [2:16:10] One Saturday, one Tuesday. [2:16:11] I know.
